Hurricane Isaias Legal Help in Destin, Santa Rosa Beach & Northwest Florida

Insurance Claims, Property Damage & Business Loss Help for Okaloosa, Walton, Santa Rosa & Escambia County Residents

Hurricane Isaias damaged your home, rental or business? Call 850-909-2225 or contact us online for a free consultation.

Hurricane Isaias made landfall near Destin on the evening of October 9, 2026, as a Category 2 hurricane, then battered communities from the Alabama line through Pensacola, Navarre, Fort Walton Beach, Destin and Santa Rosa Beach with strong winds, flooding, storm surge and widespread power outages. For many families and business owners, the damage is only the beginning. Insurance disputes, canceled bookings, lost income and unfinished real estate deals can follow for months.

At Daniel W. Uhlfelder, P.A., we are part of the community affected by this storm. Daniel Uhlfelder has lived and practiced law here for more than 25 years. We are not an out-of-town firm arriving after a hurricane. We know that getting the right storm recovery can mean the difference between a livable home and a lost one, or a viable business and a closed one, and we’re here to help homeowners, condo owners, landlords and businesses across the Emerald Coast understand their rights, protect their claims and pursue what they’re owed.

How We Can Help After Hurricane Isaias

Our experience includes real estate, construction, commercial and civil litigation. These are the areas where we see the most storm-related disputes:

  • Insurance disputes: Denied, delayed or underpaid property damage claims, disagreements over wind versus flood coverage, and policy questions for homes, condominium units, rental properties and commercial buildings.
  • Real estate litigation: Contract disputes involving damaged properties, delayed or failed closings, financing and insurance contingencies, and contract termination or deposit disputes.
  • Construction disputes: Delayed, defective or abandoned repair work, liens and contractor payment disputes.
  • Condominium and HOA matters: Special assessments, master policy claims, common-area repairs and responsibility disputes between associations and unit owners.
  • Business interruption claims: Claims under business interruption and loss-of-income coverage, and disputes over what your policy actually pays.

Navigating Insurance Can Be As Difficult As The Storm Itself

It’s hard to predict how any home, condominium unit, rental property or commercial building will hold up in a hurricane. When damage does occur, many policyholders aren’t sure how to prove their loss or what their policy actually covers. Questions we hear often after storms like Isaias:

  • Was the damage caused by wind, which your homeowner’s policy likely covers, or by flooding or storm surge, which is usually excluded and handled separately?
  • Did a fallen tree damage your home, and is your insurer covering the repairs and the cost of removal?
  • Is the insurer applying the right deductible, the right depreciation and the right scope of repairs?
  • Is the claim being delayed, underpaid or denied without a clear explanation?

If your property was damaged by Hurricane Isaias:

  1. Report the claim to your insurance company right away. Deadlines apply, and waiting can put your rights at risk.
  2. Take reasonable steps to protect your property from further damage, such as tarping a roof or boarding windows.
  3. Document all damage with photos and video before you clean up or make repairs.
  4. Make a written inventory of damaged or destroyed property.
  5. Keep a file of everything related to your claim, including copies of every document your insurer sends you.
  6. Save all receipts for temporary repairs, hotel stays, meals and other storm-related expenses.
  7. Keep a written log of every conversation with your insurer or adjuster: date, time, name and what was said.
  8. If you have flood insurance, report that claim separately. Flood policies have their own strict requirements and deadlines.
  9. Be cautious about signing contracts or paperwork from contractors, adjusters or anyone who contacts you after the storm. Have it reviewed first.

If your claim is denied, delayed or underpaid, don’t wait. Talk to a lawyer before you accept a settlement or sign a release.

Not sure where you stand? Call 850-909-2225 or contact us online.

Other Legal Problems After Hurricane Isaias

A major hurricane creates legal problems that go well beyond the insurance claim. For property owners, residents and businesses from Pensacola and Navarre to Destin and the 30A communities, we can also help with:

  • Canceled vacation rentals and bookings: Disputes among owners, guests, property managers and platforms over refunds, cancellations and lost rental income.
  • Landlord-tenant problems: Uninhabitable units, rent and lease obligations after storm damage.
  • Unemployment and workplace issues: Guidance on reemployment assistance when your job is disrupted by the storm.
  • Financial hardship: If storm losses have left you unable to keep up with your mortgage or debts, we can explain options including loan modification, foreclosure defense and bankruptcy.

Every situation is different, and many of these problems overlap. We’ll look at the full picture and help you decide where to focus first.

Frequently Asked Questions

How long do I have to file a hurricane insurance claim in Florida?
Under Florida law, you generally have one year from the date of loss to give your insurer notice of a new or reopened property claim, and 18 months to give notice of a supplemental claim. Your policy may add its own requirements, and reporting sooner protects you. If you’re unsure, talk to an attorney right away.

My insurer says it was flood damage, not wind damage. What now?
Hurricane damage often involves both wind and water, and how the cause is classified can decide whether your claim is covered. If your insurer’s explanation doesn’t add up, it’s worth having your policy and the damage evidence reviewed.

A tree fell on my home in Destin, Navarre or Santa Rosa Beach. Is that covered?
Many homeowner’s policies cover damage from a fallen tree, but coverage for tree removal and the limits that apply vary by policy. Photograph the damage before anything is moved, and have your policy reviewed if the insurer pays less than expected.

Can I cancel or get a refund on a rental or real estate contract because of the hurricane?
It depends on the contract language, including cancellation, force majeure and insurance or inspection provisions. We can review your agreement and explain your options.

Does it cost anything to talk to you?
No. Initial consultations are free.

Still have questions about your situation? Every case is different, and we’re happy to talk it through.

When You Need Someone In Your Corner, Call Daniel W. Uhlfelder, P.A.

Daniel Uhlfelder has lived and practiced law in this community for more than 25 years. We are not an out-of-town firm coming in after a hurricane. We are neighbors helping neighbors rebuild, with trial experience in real estate, construction, commercial and civil litigation. He knows how to read your policy and your contracts, and he’ll give you straightforward advice on whether you have a claim worth pursuing.

We know that many storm victims are facing real financial strain. Some matters may be handled on a contingency-fee basis, which means no attorney’s fee unless we recover for you. Whether a contingency-fee arrangement is available depends on the particular case, and any arrangement is subject to a written agreement.

Florida’s property insurance laws changed in 2022 and 2023. For most policies issued after those changes, a policyholder who wins a lawsuit against a property insurer generally can no longer recover attorney’s fees from the insurer simply for prevailing. Fee recovery may still be possible in limited situations, such as under older policies or through Florida’s offer-of-judgment rules, which can also put a policyholder at risk of owing fees. We’ll review your policy and the facts and tell you honestly how the law applies to your claim.

Whether you’re about to file your claim or you’ve already received a denial or a lowball offer, contacting us is a smart next step. Your first consultation is free. Reach us at 850-909-2225 or send us an email.
